BLUE BAMBOO MEDIA RELEASE AND WAIVER FORM
By submitting the Client Intake form, I agree to the following Agreement:
THIS MEDIA RELEASE AND WAIVER FORM (“Agreement”) is entered into by and between the submitter (“Releasor”) and Blue Bamboo ("Company"), collectively referred to as the “Parties”.
1. **PHOTO AND VIDEO RELEASE**
Releasor, for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, hereby grants to Company, its successors, assigns, and those acting with its authority and permission, the absolute, irrevocable right and unrestricted permission to take, use, reuse, publish, and republish photographic portraits, pictures, video footage of the Releasor or in which Releasor may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations, in conjunction with Releasor's own or a fictitious name, or reproductions of such photographs in color or otherwise, made through any medium at Company’s studios or elsewhere, for any purpose whatsoever, including the use in any media now known or hereafter created, including without limitation, print media, digital media, electronic media, internet, social media, television, film, radio, and multimedia projects.
2. **WAIVER AND RELEASE**
Releasor hereby waives and releases Company from any and all claims, demands, causes of action, suits, damages, costs, expenses, fees (including, without limitation, reasonable attorney’s fees and costs), judgments, liabilities, losses, and harms (whether in contract, tort, under statute, or otherwise) arising from or relating to the use, exploitation, display, distribution, publication, and/or other utilization of the Materials (as defined below).
3. **RIGHTS AND OBLIGATIONS**
Releasor acknowledges and agrees that Company will own all rights (including, without limitation, copyright) in and to the photographs and videos (collectively, the “Materials”) and will have the exclusive right to make use of the Materials for any purpose, including, but not limited to, social media, online uses, email blasts, printed materials, and other forms of advertising. Releasor hereby assigns to Company all right, title, and interest in and to the Materials, including, without limitation, all copyright.
4. **REPRESENTATION**
Releasor represents and warrants that Releasor is at least 18 years of age and has the full legal capacity to execute this Agreement. Releasor agrees that this release is binding on Releasor and Releasor’s heirs, legal representatives, and assigns.
5. **GOVERNING LAW**
This Agreement shall be governed by and construed in accordance with the laws of the state of West Virginia without regard to its conflicts of law principles.
By submitting the Client Intake form, the Releasor has executed this Media Release and Waiver Form as of the date this form was submitted.
