BLUE BAMBOO SERVICE AGREEMENT AND WAIVER AGREEMENT 

 

By submitting the Client Intake form, I agree to the following Agreement:

This Agreement is entered into between the client, hereinafter referred to as “Client,” and Blue Bamboo, hereinafter referred to as “Company.”

 

ACKNOWLEDGMENT OF RISKS

Client acknowledges that they are aware of the potential risks, side effects, and complications involved with the following modalities:

  • Cold Contouring

    • Side Effects: Temporary redness, swelling, and numbness in the treated area. 

    • Management: Most side effects subside on their own within 2-3 weeks. Over-the-counter pain relievers can help with discomfort.

    • Duration: Clients should see maximum results within 8-12 weeks. However, multiple sessions may be required for optimal results.

  • WaveSculpt Trio

    • Side Effects: Mild discomfort, redness, and temporary swelling in the treated area. 

    • Management: Use of a cold pack and over-the-counter pain relievers can help alleviate discomfort. 

    • Duration: Maximum results are typically seen within 10-12 weeks. Multiple sessions may be necessary for the best outcome.

  • SculptFlex Elite (EMS & Radio Frequency (RF))

    • Side Effects: Temporary skin redness, mild bruising, and temporary numbness in the treated area.

    • Management: Over-the-counter pain relievers and cold packs can help manage symptoms.

    • Duration: Clients can expect to see maximum results within 6-8 weeks. More sessions may be necessary for desired results.

  • EMS Neo (Electro-Muscular Stimulation (EMS) with RF)

    • Side Effects: Temporary redness, tingling, and muscle tenderness.

    • Management: Rest, light stretching, and over-the-counter pain relievers can help alleviate discomfort.

    • Side Effects: Temporary redness, mild swelling, and warmth in the treated area.

    • Management: Cooling the area and using over-the-counter pain relievers can help manage symptoms.

    • Duration: Clients can expect to see maximum results within 2-3 months. More sessions may be required for optimal results.

  • RadioFrequency (RF) Body Contouring

    • Side Effects: Temporary redness, swelling, and mild discomfort in the treated area.

    • Management: Over-the-counter pain relievers and a cold pack can alleviate discomfort.

    • Duration: Clients should see maximum results within 8-10 weeks. Additional sessions may be necessary for optimal results.

  • Z-Wave (Shockwave) Therapy Body Contouring

    • Side Effects: Temporary redness, bruising, and discomfort in the treated area.

    • Management: Over-the-counter pain relievers can help manage discomfort.

    • Duration: Maximum results are typically seen within 6-8 weeks. More sessions may be necessary for the best outcome.

  • Z-Wave (Shockwave) Therapy - NOT for Body Contouring

    • Side Effects: Temporary redness, mild discomfort, and bruising at the treatment site.

    • Management: Application of a cold pack and over-the-counter pain relief (but not ibuprofen)

    • Results: Pain relief varies by individual, but most clients see improvements within 6-8 weeks. Additional sessions may be necessary for optimal results.

RELEASE OF LIABILITY

Client hereby releases and forever discharges Company, its agents, employees, officers, directors, affiliates, successors, and assigns, from any and all manner of rights, claims, complaints, demands, debts, liabilities, obligations, promises, acts, agreements, costs, expenses, damages, and causes of action, whether in law or equity, whether known or unknown, arising out of or in connection with any treatment, procedure, or service provided by Company.
 

INDEMNIFICATION

Client agrees to indemnify, defend, and hold harmless the Company from any and all claims arising as a result of or related to the services received.
 

NO GUARANTEES

Company does not guarantee any particular result, and any and all results may vary. The Client acknowledges this variability and accepts the risks associated with the services received.
 

SEVERABILITY

If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be deemed severed from this Agreement and the remainder of this Agreement will remain in full force and effect, provided that the remaining provisions continue to fulfill the original intent of the parties. If the original intent cannot be fulfilled, the offending provision will be modified so as to fulfill the original intent of the parties.
 

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction of West Virginia.
 

ENTIRE AGREEMENT

This Agreement, together with all of the waivers, releases, and forms noted within and submitted with the Client Intake form, all constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior discussions, negotiations, and agreement, whether oral or written.
 

By submitting and/or eSigning the Client Intake form, the Client acknowledges that they have read and understand the terms and conditions set forth herein, that they agree to, and comply with all of its terms and conditions, that they have had an opportunity to consult with counsel of their choice, and that they are signing this Agreement voluntarily.
